Terms and conditions

1. This promotional competition is open to all persons aged 18 and over except citizens of the USA and except the Promoter’s employees or members of their immediate family, agents or any other person who is connected with the creation or administration of this competition.

2. Customer is purchasing a membership for desired period of time for our car enthusiast club “Klub aut, o.s” (ID 22675337). The competition is only open for club members. The length of membership determines number of competition entries customer is entitled to.

3. By entering this membership and competition the entrant will be deemed to have read and understood these rules and to be bound by them and by any other requirements set out in any related promotional material. The competition is governed by Czech Law and any matters relating to the competition will be resolved under Czech Law and the Courts of Czech Republic shall have exclusive jurisdiction. By accepting these terms and conditions you confirm that you are not breaching any laws in your country of residence regarding the legality of entering our competitions. If in doubt, please check with relevant authorities. The Promoter will not be held responsible for any entrant entering any of our competitions unlawfully. If in any doubt you should check with the relevant authorities in your country.

4. To enter the game, follow the on-screen instructions Using all the information shown in the photograph displayed on the computer screen (from which puck has been permanently erased), use your skill and judgment to correctly identify the grid square within which you consider the judge will decide is the most likely position of the centre of the puck. Click on the screen to mark this spot (you can see your spot’s coordinates on the screen). When you are ready to purchase your ticket, follow the on-screen instructions to provide your contact details and then your credit card details. When your credit card payment is cleared we will then contact you by email to confirm your entry into the competition. Only after the payment has been cleared the customer's entry is valid.

5. Each competition finishes when planned number of tickets is sold.

6. A customer may cancel purchase of a membership within 14 days of the original purchase. In such case 20% handling fee stall be deducted from the returned amount.

7. The centre of the puck position will be determined by an independent judge (a sporting expert appointed by the Promoter), using his hockey experience in the presence of a lawyer and a representative from the Promoter. The judge's chosen position will then be computed against the database of coordinates to mathematically calculate which of the competitors is closest to the judge’s position, and therefore the winner of the prize. The winner will be the person who correctly identifies, or if no one is correct, who is closest to, the grid square within which the centre of the puck is judged to be located. In the event of a tie the joint winners will be asked to take part in another “spot the puck” competition so that we can determine a single winner. The entry mechanism will be exactly the same as before but with a new photograph and there will be no payment due. The competition will be judged in exactly the same way to determine the winner. In the very unlikely event there is another tie the process will be repeated until there is a single winner.

8. The winner will be notified at the address or telephone number given in the contact details within 2 days of the closing date of the relevant competition. Any entrant may check the results of competitions completed within the last 24 months at our website.

9. The winner will be required to send a copy of their passport to the Promoter to confirm their identity, age and also to prove that if the purchase was made by credit card that the card was legally theirs or they had authorization to use it, before any prize will be paid or delivered. The winner will also be required to provide photographs for use in future marketing by the Promoter. Following receipt and verification of the details above by the Promoter, the winner will be contacted in order to make arrangements for delivery of the prize.

10. In the European Union and the UK the prize will be delivered with VAT paid but any other taxes/import duties/registration costs due will be the responsibility of the prizewinner. In all other countries the prize will be shipped (net of all taxes except sales tax/GST/VAT) to the nearest port and any applicable import duties/registration costs or withholding tax due in the destination country will be the responsibility of the prizewinner. The promoter reserves the right not to deliver to certain countries. Promoter has not yet purchased the prize but will do so when the winner is announced. The prize will be purchased at market price (difference between MSRP and market price up to +18% will be covered by the Promoter) with left/right hand drive specification depending on winner’s country of residence. The Promoter will discuss with the winner his/her desired specification but will have the sole discretion as to the specification and color of the prize depending on market conditions. Due to limited availability of certain models, delivery of the prize to the winner may take couple of months.

11. Should the winner not wish to take delivery of one of the prizes detailed above, the cash alternative of MSRP incl. VAT/GST/sales tax may be taken by the winner.

12. The Promoter will store the chosen prize free of charge for 30 days after notifying the winner, at the end of which time the car will be delivered to the winner.

13. Promoter will notify the winner by email and telephone. Should the winner be unreachable within 30 days after the announcement, he/she loses the right to claim the prize.

14. Acceptance of the prize by the winner gives the Promoter the right to use the prize-winner’s name, personal photograph and home country for promotional purposes, both immediately after their win and in the future, unless prohibited by law.

15. The Promoter reserves the right to cancel any competition, for any reason, before the designated number of tickets is sold. In these circumstances the Promoter reserves the right to transfer the customer’s ticket into another competition.

16. The Promoter makes no representations or warranties as to the quality/suitability of any of the goods or services offered as prizes. Except for liability for death or personal injury caused by the negligence of the Promoter, the Promoter shall not be liable for any loss suffered or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods by any person to the prize-winner and, where applicable, to any family/persons accompanying the winner, or in connection with any of the competitions promoted by the Promoter.

17. No responsibility will be accepted for failed, partial or garbled computer transmissions, for any computer, telephone, cable, network, electronic or internet hardware or software malfunctions, failures, connections, availability, for the acts or omissions of any service provider, internet, accessibility or availability or for traffic congestion or unauthorized human act.

18. Data Protection Notice: Any personal data that you supply to the Promoter or authorize the Promoter to obtain from a third party, for example, a credit card company, will only be used by the Promoter to administer the competition.

19. In order to process, record and use your personal data the Promoter may disclose it to

    1. any credit card company whose name you give;
    2. any organization (whether or not connected to the Promoter) for the purpose of bringing to your attention goods and services which the Promoter considers may be of interest to you;
    3. any person to whom the Promoter proposes to transfer any of the Promoter's rights and/or responsibilities under any agreement the Promoter may have with you;
    4. any person to whom the Promoter proposes to transfer its business or any part of it;
    5. comply with any legal or regulatory requirement of the Promoter in any country; and
    6. prevent, detect or prosecute fraud and other crime.
